Filing a FOIA Request in DuPage County
Most DuPage County police records require a FOIA request. The Illinois Freedom of Information Act gives you the right to ask for and get copies of public records from government bodies. This applies to the sheriff, the county government, and municipal police departments across DuPage County.
A good FOIA request for DuPage County police records should include several pieces of information. Put your full name, mailing address, and a daytime phone number on the request. Describe the records you want with as much detail as you can. If you know the case number, include it. List the date of the incident and the names of the people involved. Avoid broad language like "all records related to" because that kind of request can be pushed back as unduly burdensome under the law. The agency must respond within five business days and can extend to ten if it sends a written notice. Under 20 ILCS 2630/, the Criminal Identification Act, certain arrest records that did not result in conviction may be sealed or expunged, which means they would not be part of a FOIA response.
Note: Circuit Clerks are part of the judicial branch and generally fall outside the scope of FOIA in DuPage County; request court records directly from the clerk's office.
